CursUP 服务条款
欢迎使用 CursUP(以下简称"本服务"、"平台"或"我们")。本协议是您与 CursUP 团队(以下简称"我们")就您注册、访问或使用本平台所达成的具有法律约束力的协议。 请您在使用前 仔细阅读并充分理解 本协议的全部条款,特别是涉及免责、责任限制、法律适用与争议解决的条款。如您不同意本协议,请立即停止使用本服务。
一、总则与协议范围
1.1 本协议适用于您通过 CursUP 网站、控制台、命令行、MCP Server 及其他随技术发展出现的新形态访问或使用我们提供的全部产品与服务。
1.2 本协议构成您与我们之间就本服务所达成的完整协议,并取代之前关于同一事项的任何口头或书面理解。
1.3 我们可能不时根据法律法规变化、产品调整或业务需要修订本协议,更新后的协议将在本页面发布,标注新的更新日期。如您不同意修订内容,请停止使用本服务;继续使用即视为接受。
二、账号注册与安全
2.1 注册资格
您应当是具备完全民事行为能力的自然人、法人或其他组织,且未受任何国家、国际组织或地域实施的贸易限制、制裁或其他法律限制。如您为未成年人,请在监护人陪同下阅读本协议并使用本服务。
2.2 注册方式
- 邮箱 + 密码注册:您需要提供真实有效的邮箱、昵称及不少于 8 位的密码。
- 第三方账号登录:本服务支持通过 Google、Twitter、微信等第三方平台登录,您授权我们从第三方获取必要的账号信息(如用户标识、昵称、邮箱、头像)。第三方账号本身的使用受其各自服务协议约束。
2.3 账号安全
您应妥善保管账号与密码,不得将账号借予他人使用,亦不得通过批量注册、虚假注册等方式滥用注册功能。因您未尽妥善保管义务导致的任何损失,由您自行承担。如您发现账号存在未授权使用,应立即通知我们,我们将协助您冻结账号、防止进一步损失。
三、服务说明
CursUP 提供以下主要功能:
- 控制台(/console):包含概览、我的应用、MCP 配置、应用模板等模块,供您管理在平台上创建的应用。
- 应用模板:提供
static-web、node-api、python-api等标准模板。模板中内置platform.app.yaml编码 Rules 与 Skills。 - MCP Server / Token:您可在控制台生成专属的 API Token,用于让 AI Agent (如 Cursor) 通过 MCP 协议直接调用本平台的应用创建、发布、部署、状态查询等工具。
- 应用部署与访问 URL:通过 MCP 工具完成构建与部署后,平台为应用分配访问地址,供您或您授权的最终用户访问。
四、MCP API Token
4.1 您在控制台「MCP 配置」中生成的 API Token 等同于您的身份凭证。通过该 Token 调用本平台 API 所产生的任何操作,均视为您本人或经您授权的行为。
4.2 您应将 Token 视同密码妥善保管,不得明文发布、提交到公开代码仓库或分享给无关第三方。如您怀疑 Token 已泄露,应立即在控制台中点击「重新生成」轮换 Token,旧 Token 将立即失效。
4.3 我们保留在以下情况下吊销或重置您的 Token 的权利:
- 检测到异常调用、滥用或可能威胁平台稳定性的行为;
- 违反本协议或相关法律法规;
- 司法、行政机关要求;
- 账号被冻结、注销或长期未活跃。
五、使用规范与禁止行为
5.1 合规要求
您应遵守《网络安全法》《数据安全法》《个人信息保护法》《生成式人工智能服务管理暂行办法》《互联网信息服务管理办法》及其他相关法律法规,遵循公序良俗,不得损害国家利益、公共利益和他人合法权益。
5.2 内容禁止
您不得通过本服务上传、发布、传输、生成或部署包含以下内容的信息或应用:
- 反对宪法所确定的基本原则,危害国家安全、统一、主权和领土完整的;
- 泄露国家秘密、危害公共利益的;
- 宣扬恐怖主义、极端主义、民族仇恨与歧视的;
- 散布淫秽、色情、赌博、暴力、凶杀、恐怖或者教唆犯罪的;
- 侮辱、诽谤他人,侵害他人名誉、隐私、肖像、知识产权等合法权益的;
- 编造、传播虚假信息扰乱社会与经济秩序,从事或协助实施诈骗的;
- 未经授权处理他人个人信息、商业秘密的;
- 未经专业人员审核即向公众提供医疗、法律、投资、信贷等专业建议的;
- 其他违反法律法规、政策或本协议的内容。
5.3 技术使用禁止
您不得自行或允许、协助任何人:
- 通过爬虫、自动化脚本、批量调用等方式对平台施加不合理负载;
- 对本服务及其组件进行反向工程、反编译、反汇编或试图获取源代码、模型权重;
- 未经许可探测、扫描或测试本平台系统、网络或其他用户应用的漏洞;
- 使用第三方非授权工具登录、操作本服务,或绕过平台的速率限制、计量与计费机制;
- 制作、传播包含病毒、木马、勒索软件或其他恶意代码的应用;
- 冒用他人身份、伪造请求、绕过身份验证;
- 转售、转租、转授权您对本服务的访问权限。
六、AI 生成内容与第三方服务
6.1 本服务依托大语言模型与多种人工智能技术,受现有技术限制,AI 输出的内容可能不准确、不完整甚至包含错误或冒犯性信息。任何输出均不代表本平台的立场或观点。
6.2 在将 AI 生成内容(包括但不限于代码、文本、配置)应用于生产环境或对外发布前,您应当 进行人工审核与必要的测试。在未经审核的情况下,不得将其用于可能产生法律或重大实质性影响的决策场景(如信贷、医疗、法律、雇佣等)。
6.3 本服务可能集成或调用第三方大模型服务(如 OpenAI、Anthropic、阿里通义等)与其他第三方服务(如代码托管、对象存储、CDN、构建工具)。当您使用相关功能时,相关输入与输出数据可能依据技术需要传输至对应的第三方,相关数据处理 受该第三方自身协议与隐私政策约束,我们对其可用性、性能、安全性与数据实践不作承诺,也不承担责任。
七、用户内容与知识产权
7.1 平台知识产权
CursUP 平台本身(包括但不限于品牌、商标、域名、网站架构、UI 设计、控制台与 MCP Server 的代码与算法、官方应用模板、平台文档与营销内容)的全部知识产权归 CursUP 团队所有,受著作权、商标权、专利权及相关法律保护。未经书面授权,您不得复制、修改、分发、镜像或衍生使用。
7.2 您的内容
您在本服务中输入、上传、生成或部署的内容(统称"您的内容"),包括但不限于应用代码、配置文件、文档、提示词、应用数据,其知识产权归您或原始权利人所有。您承诺您拥有合法的权利或已获得合法授权。
7.3 AI 输出的归属
我们对 AI 模型基于您的输入所生成的输出 不主张任何所有权。在符合法律的前提下:
- 您可自由地使用、修改、商业化分发 AI 生成的代码;
- 您可将生成的代码以任何许可形式(包括开源)发布;
但您应自行判断 AI 输出在您当地法律环境下的知识产权可主张性,并对其使用与传播承担全部责任。
7.4 必要的使用授权
为运营本服务,您许可我们在经技术处理(如脱敏、聚合统计)且无法识别特定个人的前提下,将您的内容用于:
- 提供、维护、改进本服务(含故障排查、安全审计、客户支持);
- 统计平台运行指标与稳定性;
- 遵守法律法规与执行本协议。
- 如发现您的应用存在违法所在国家/地区法律法规,我们将立即停止服务,并配合相关部门调查。
我们不会出于训练通用模型的目的使用您的应用代码与私有数据,除非经您明确同意。
八、您发布的应用与最终用户
8.1 通过 MCP 工具或控制台部署后的应用,由平台分配访问地址(形如 https://<app>-<env>.cursup.dev)。任何访问您所部署应用的人,均视为您的"最终用户",与我们之间不存在直接的服务关系。
8.2 您应对您的应用与最终用户负全部责任,包括但不限于:
- 依法向最终用户披露隐私政策、获取必要授权;
- 对应用内的内容、功能、运营行为承担全部合规责任;
- 设置适当的身份认证机制,特别是涉及实名要求的场景;
- 合理处理最终用户的数据,确保数据安全;发生泄露或安全事件应及时告知我们;
- 在法律法规或行业规范要求标识 AI 生成内容的场景下,依法在您的应用中添加显式标识。
8.3 您发布的应用访问 URL 中可能包含 cursup.dev 或类似平台标识。该标识仅表示部署位置,不构成本平台对您发布内容的认可、背书或担保。
九、违约处理与账号管理
9.1 如您违反本协议,我们可根据违规的性质与严重程度,独立判断并采取以下一项或多项措施:
- 事先警示、要求整改;
- 限制账号部分或全部功能;
- 暂停或终止应用部署、收回访问 URL;
- 吊销 MCP Token;
- 暂时或永久冻结账号;
- 删除违规内容、应用与相关数据;
- 追究法律责任并向有权机关报告。
9.2 除紧急情况、法律另有要求或不可能事先通知的情形外,我们将以站内消息或邮件等方式提前通知您。您因违规导致的服务中断、数据删除、已消耗资源损失等不利后果,由您自行承担。
9.3 如您的行为导致我们或我们的关联方遭受第三方索赔、行政处罚或其他经济损失(包括但不限于赔偿金、和解款、律师费、诉讼费及商誉损失),您应承担赔偿责任。
十、服务变更与终止
10.1 您可以随时停止使用本服务并申请注销账号。注销后,您的账号、应用、Token 与相关数据将在合理时间内删除,不再可恢复。
10.2 在以下情况下,我们可暂停或终止向您提供服务:
- 您严重违反本协议或相关法律法规;
- 因技术故障、安全事件或不可抗力需要暂停部分或全部服务;
- 司法、行政机关要求;
- 本服务整体调整、合并、停止运营。
10.3 服务终止后,本协议中关于知识产权、责任限制、争议解决等条款依其性质仍应继续有效。
10.4 安全应急响应
10.4.1 当平台或您所部署的应用遭到 分布式拒绝服务(DDoS)攻击、大规模异常流量、暴力登录尝试、漏洞利用、勒索或其他显著危及平台稳定性、其他用户应用可用性或数据安全的事件 时,为最大限度减少危害扩散,我们有权 无需事先通知 在合理范围内采取一项或多项应急处置措施,包括但不限于:
- 暂时停止涉事应用 / 平台域名(含
cursup.dev及其子域)的 DNS 解析,使涉事流量无法到达源站; - 启用 CDN / WAF 流量清洗、人机校验、限速与黑白名单策略;
- 临时阻断特定 IP、网段、地区或客户端来源;
- 临时吊销涉事 MCP Token 或临时冻结涉事账号;
- 将涉事应用临时下线或将其迁移到隔离环境;
- 其他法律法规允许且为应急处置所必要的措施。
10.4.2 上述应急措施仅以 足以缓解危害所必需的范围与时间 为限。事件得到控制后,我们将在合理时间内尽快恢复正常服务,并通过站内消息、邮件或本页公告等方式向您说明事件情况与影响范围。如您所部署的应用本身是攻击的成因或受益方(如用于发起攻击、放大攻击流量等),我们可在调查后依据本协议第九条作进一步处理。
10.4.3 您理解并同意:因前述应急措施导致的服务暂时不可达、连接中断、最终用户无法访问您的应用、相关业务损失等后果,属于平台为保障整体安全所必要的处置,我们不承担违约或赔偿责任,您同时应配合我们调查并采取必要的补救措施(如修复漏洞、清理恶意内容、加强自有应用的认证机制等)。
十一、免责声明与责任限制
11.1 本服务按"现状(as is)"和"现有可用(as available)"提供。在适用法律允许的最大范围内,我们不就服务的适销性、特定用途适用性、不侵权、连续性、安全性、准确性作出任何明示或默示的担保。
11.2 在适用法律允许的最大范围内,对于以下情形导致的服务中断、数据丢失、性能下降或不能满足您预期的,我们不承担违约责任:
- 不可抗力(自然灾害、战争、政府行为、司法行政命令等);
- 电力、通讯网络、公共云、第三方依赖(如大模型 API)等不可控因素;
- 我们已尽善意管理义务的常规或紧急维护、设备故障、网络与数据安全事件;
- 依据 第 10.4 条 采取的安全应急响应措施(包括但不限于临时停止域名解析、流量清洗、阻断 IP / 区域、临时下线应用等);
- 因您自身行为、配置错误或第三方原因导致的问题。
11.3 在任何情况下,我们及关联方对您承担的全部责任合计不超过您在事件发生前 12 个月内为本服务向我们实际支付的费用(若您未付费,则以人民币 100 元为限)。我们对任何间接的、偶然的、特殊的、惩罚性的或后果性损失(包括利润损失、商誉损失、数据损失)不承担责任,即便我们已被告知该等损失的可能性。
十二、未成年人使用
未成年人使用本服务应当在监护人监督指导下进行,监护人应承担相应的监督教育责任。我们提醒您:避免在公开应用中发布包含未成年人个人信息的内容。如您发现未成年人在未经监护的情况下使用本服务,请及时与我们联系。
十三、反馈
我们欢迎您通过站内反馈、邮件或社区渠道向我们提供使用反馈、功能建议或问题报告。您同意我们可以无偿地以任何方式使用您提供的反馈(包括用于改进本服务、形成新功能或公开发布),无需向您支付任何费用或保留署名。
十四、协议修改
我们可能不时修改本协议。当发生重大修改时,我们将通过站内公告或邮件方式提前通知您。修改后的版本将在本页面公布并标注"更新日期"。您在修改生效后继续使用本服务,即视为接受修改后的协议;如您不同意,请停止使用本服务。
十五、法律适用与争议解决
15.1 本协议的订立、生效、解释、修订、终止与执行均适用中华人民共和国法律(不含香港、澳门、台湾地区法律)。
15.2 因本协议或与本服务相关的争议,双方应首先友好协商解决;协商不成的,任何一方均可向我们运营主体所在地有管辖权的人民法院提起诉讼。
15.3 本协议任一条款被认定为无效或不可执行的,不影响其他条款的有效性。我们未行使任何权利或救济,不构成对该权利或救济的放弃。

CursUP Terms of Service
Welcome to CursUP (the "Service", "Platform", or "we"). This agreement is a legally binding contract between you and the CursUP team regarding your registration, access to, or use of the Platform. Please read and fully understand all the terms before using the Service, especially those related to disclaimers, liability limits, governing law and dispute resolution. If you do not agree, stop using the Service immediately.
1. General provisions and scope
1.1 This agreement applies to your access to and use of any product or service we provide via the CursUP website, console, command line, MCP Server, and any new form that may emerge as the technology evolves.
1.2 This agreement constitutes the entire agreement between you and us regarding the Service and supersedes any prior verbal or written understandings on the same subject.
1.3 We may revise this agreement from time to time in response to changes in laws, product updates or business needs. The updated version will be published on this page with a new "last updated" date. If you do not agree to the changes, please stop using the Service; continued use is deemed acceptance.
2. Account registration and security
2.1 Eligibility
You must be a natural person, legal entity or other organization with full civil capacity, and must not be subject to any trade restriction or sanction imposed by any country, international organization or jurisdiction. If you are a minor, please read this agreement and use the Service in the presence of a guardian.
2.2 Registration methods
- Email + password: provide a real, valid email, a display name, and a password of at least 8 characters.
- Third-party login: the Service supports sign-in via Google, Twitter, WeChat and similar providers. You authorize us to retrieve necessary account information (such as user identifier, display name, email, avatar) from the third party. Use of the third-party account itself is governed by that party's terms.
2.3 Account security
You should keep your account and password safe, never lend them to others, and not abuse the registration feature via bulk or fake registrations. Any loss caused by your failure to safeguard your account is your sole responsibility. If you discover unauthorized use, notify us immediately so that we can help freeze the account and prevent further loss.
3. Service description
CursUP provides the following primary capabilities:
- Console (/console): includes overview, my apps, MCP configuration, app templates and other modules to manage apps you create on the platform.
- App templates: standard templates such as
static-web,node-api,python-api, with built-inplatform.app.yamlencoding our Rules and Skills. - MCP Server / Token: in the console you can generate a personal API token that lets AI agents (such as Cursor) directly invoke platform tools — app creation, release, deploy, status — over MCP.
- App deploy and access URL: after build & deploy via MCP tools, the platform assigns an access URL for you and your authorized end users.
4. MCP API token
4.1 The API token generated under "MCP configuration" in the console is equivalent to your identity credential. Any operation performed using this token is treated as your own action or one authorized by you.
4.2 Treat the token like a password — do not publish it in clear text, push it to public repos or share it with unrelated third parties. If you suspect the token has leaked, immediately rotate it via the console; the old token is invalidated instantly.
4.3 We reserve the right to revoke or reset your token in the following situations:
- abnormal calls, abuse, or behavior that may threaten platform stability;
- violation of this agreement or applicable laws and regulations;
- requests from judicial or administrative authorities;
- your account has been frozen, deactivated, or inactive for an extended period.
5. Acceptable use and prohibited conduct
5.1 Compliance
You shall comply with the Cybersecurity Law, Data Security Law, Personal Information Protection Law, Interim Measures for Generative AI Services, Internet Information Service Management Measures, and other applicable laws and regulations of the People's Republic of China, observe public order and morality, and refrain from harming national interests, public interests, or the legitimate rights of others.
5.2 Prohibited content
You shall not upload, publish, transmit, generate or deploy via the Service any information or app containing the following:
- content opposing the basic principles of the Constitution or endangering national security, unity, sovereignty or territorial integrity;
- content disclosing state secrets or harming public interest;
- content promoting terrorism, extremism, ethnic hatred or discrimination;
- obscene, pornographic, gambling, violent or homicidal content, or content inciting crime;
- content insulting or defaming others, or infringing reputation, privacy, portrait, IP or other lawful rights;
- fabricated or disseminated false information that disturbs social or economic order, or content engaged in or assisting fraud;
- processing of others' personal information or trade secrets without authorization;
- medical, legal, investment, credit or other professional advice provided to the public without review by qualified professionals;
- any other content that violates laws, regulations, policies or this agreement.
5.3 Prohibited technical conduct
You shall not, by yourself or by allowing or assisting any other party:
- impose unreasonable load on the platform via crawlers, automation scripts, or bulk calls;
- reverse engineer, decompile, disassemble, or attempt to extract source code or model weights of the Service or its components;
- probe, scan, or test the platform's systems, network, or other users' apps for vulnerabilities without authorization;
- use unauthorized third-party tools to log in or operate the Service, or bypass rate limits, metering or billing mechanisms;
- create or distribute apps containing viruses, trojans, ransomware or other malicious code;
- impersonate others, forge requests, or bypass authentication;
- resell, sublicense, or transfer your access to the Service.
6. AI-generated content and third-party services
6.1 The Service relies on large language models and other AI technologies. Limited by the current state of the technology, AI output may be inaccurate, incomplete, or even contain errors or offensive material. No output represents the position or views of the platform.
6.2 Before using AI-generated content (including but not limited to code, text, configuration) in production or releasing it externally, you should perform human review and necessary testing. Without such review, do not use it for decisions with potentially significant legal or material consequences (e.g. credit, medical, legal, employment).
6.3 The Service may integrate or call third-party large-model services (e.g. OpenAI, Anthropic, Alibaba Tongyi) and other third-party services (e.g. code hosting, object storage, CDN, build tools). When you use such features, the relevant input/output data may be transmitted to those parties as needed; that data processing is governed by the third party's own terms and privacy policy. We make no commitment about their availability, performance, security or data practices and accept no liability therefor.
7. User content and IP
7.1 Platform IP
All intellectual property in the CursUP platform itself (including but not limited to brand, trademarks, domain, site architecture, UI design, console and MCP Server code and algorithms, official app templates, platform docs and marketing content) is owned by the CursUP team and is protected by copyright, trademark, patent, and related laws. You may not copy, modify, distribute, mirror or derive from it without prior written authorization.
7.2 Your content
Content you input, upload, generate or deploy through the Service (collectively "your content") — including but not limited to app code, configuration, docs, prompts, app data — remains the IP of you or its original rights holder. You represent that you have the lawful right or have obtained the necessary authorization.
7.3 Ownership of AI output
We claim no ownership over AI output generated based on your input. Subject to applicable law:
- you may freely use, modify, and commercially distribute AI-generated code;
- you may publish the generated code under any license, including open source.
However, you must judge for yourself whether AI output is enforceable as IP under your local law, and you bear full responsibility for its use and distribution.
7.4 Operational license
To operate the Service, you grant us — provided the data has been processed (e.g. anonymized, aggregated) so that no specific individual can be identified — the right to use your content for:
- providing, maintaining and improving the Service (including troubleshooting, security audit, customer support);
- measuring platform operational metrics and stability;
- compliance with laws and enforcement of this agreement;
- If your app is found to violate the laws or regulations of the country/region in which it operates, we will immediately stop providing the Service and cooperate with the competent authorities in their investigation.
We will not use your application code or private data to train general-purpose models, unless you give explicit consent.
8. Apps you publish and their end users
8.1 Apps deployed via MCP tools or the console are assigned access URLs (in the form https://<app>-<env>.cursup.dev). Anyone who visits an app you deploy is considered your "end user" and has no direct service relationship with us.
8.2 You are fully responsible for your app and your end users, including but not limited to:
- disclosing privacy policies and obtaining necessary authorizations from end users in accordance with the law;
- full compliance responsibility for content, features and operations within your app;
- setting up appropriate authentication, especially in scenarios that require real-name verification;
- handling end-user data reasonably, ensuring data security, and notifying us promptly of any leak or security incident;
- where laws or industry rules require labeling of AI-generated content, adding the appropriate disclosure within your app.
8.3 The access URL of your published app may contain cursup.dev or a similar platform identifier. This identifier merely indicates where the app is hosted and does not constitute the platform's endorsement, recommendation or guarantee of your content.
9. Breach handling and account management
9.1 If you breach this agreement, we may, depending on the nature and severity, take one or more of the following measures at our sole discretion:
- prior warning and a request for remediation;
- limiting some or all account features;
- suspending or terminating app deployments and reclaiming access URLs;
- revoking the MCP token;
- temporarily or permanently freezing the account;
- deleting violating content, apps and related data;
- pursuing legal liability and reporting to the competent authorities.
9.2 Except in emergencies, where required by law, or where prior notice is not possible, we will give you advance notice via in-app message or email. You bear any service interruption, data deletion, or loss of consumed resources caused by your violation.
9.3 If your conduct causes us or our affiliates to be subject to third-party claims, administrative penalties or other economic loss (including but not limited to compensation, settlement, attorneys' fees, litigation fees and reputational damage), you shall indemnify us.
10. Service changes and termination
10.1 You may stop using the Service and request account deactivation at any time. After deactivation, your account, apps, tokens and related data will be deleted within a reasonable time and cannot be recovered.
10.2 We may suspend or terminate the Service to you in the following situations:
- you seriously breach this agreement or applicable laws;
- partial or full Service must be suspended due to technical failure, security incident or force majeure;
- requests from judicial or administrative authorities;
- overall adjustment, merger or shutdown of the Service.
10.3 Provisions concerning IP, liability limits, and dispute resolution shall survive termination by their nature.
10.4 Security incident response
10.4.1 When the platform or apps you deploy are subject to a distributed denial-of-service (DDoS) attack, large-scale abnormal traffic, brute-force login attempts, vulnerability exploitation, ransom or other event that materially threatens platform stability, the availability of other users' apps, or data security, we may, in order to minimize harm, take one or more emergency measures without prior notice within a reasonable scope, including but not limited to:
- temporarily suspending DNS resolution of the affected app or platform domain (including
cursup.devand its subdomains) so that traffic cannot reach the origin; - enabling CDN / WAF traffic scrubbing, CAPTCHA, rate limits, and allow/deny lists;
- temporarily blocking specific IPs, subnets, regions, or client sources;
- temporarily revoking the affected MCP token or freezing the affected account;
- temporarily taking the affected app offline or migrating it to an isolated environment;
- any other measures permitted by law and necessary for emergency response.
10.4.2 The above emergency measures are limited to the scope and duration necessary to mitigate the harm. Once the incident is under control, we will restore normal service as soon as reasonably possible and explain the situation and impact via in-app message, email, or a notice on this page. If your app itself caused or benefited from the attack (e.g. used to launch attacks or amplify traffic), we may take further action under Section 9 after investigation.
10.4.3 You understand and agree: any temporary unavailability, connection loss, end-user inability to reach your app, or related business loss caused by these emergency measures are necessary actions taken by the platform to safeguard overall security; we accept no breach or compensation liability. You shall cooperate with our investigation and take any necessary remediation (e.g. patching vulnerabilities, removing malicious content, strengthening your app's authentication).
11. Disclaimers and limitation of liability
11.1 The Service is provided "as is" and "as available". To the maximum extent permitted by law, we make no express or implied warranty of merchantability, fitness for a particular purpose, non-infringement, continuity, security or accuracy.
11.2 To the maximum extent permitted by law, we shall not be liable for breach in the following situations resulting in service interruption, data loss, performance degradation or failure to meet your expectations:
- force majeure (natural disaster, war, government action, judicial or administrative order, etc.);
- uncontrollable factors such as power, telecom networks, public cloud, or third-party dependencies (e.g. LLM APIs);
- routine or emergency maintenance, equipment failure, network or data security events for which we have exercised reasonable care;
- security emergency-response measures taken under Section 10.4 (including but not limited to temporary DNS suspension, traffic scrubbing, IP / region blocking, taking apps offline);
- issues caused by your own actions, configuration mistakes or third parties.
11.3 Under no circumstances shall the total aggregate liability of us and our affiliates to you exceed the fees you actually paid to us for the Service in the 12 months preceding the event (or RMB 100 if you have not paid). We are not liable for any indirect, incidental, special, punitive or consequential damages (including loss of profit, goodwill or data), even if we have been advised of the possibility of such losses.
12. Use by minors
Use of the Service by minors should be supervised and guided by their guardians, who shall bear the corresponding supervisory and educational responsibility. Reminder: avoid publishing content containing minors' personal information in public apps. If you discover a minor using the Service unsupervised, please contact us promptly.
13. Feedback
We welcome your feedback, feature suggestions, or bug reports via in-app feedback, email, or community channels. You agree that we may use the feedback you provide free of charge in any manner (including for improving the Service, building new features, or public release) without payment or attribution.
14. Modifications
We may modify this agreement from time to time. For material changes, we will give you advance notice via an in-app announcement or email. The updated version will be published on this page with a new "last updated" date. Continued use after the modification takes effect is deemed acceptance; if you do not agree, stop using the Service.
15. Governing law and disputes
15.1 The conclusion, validity, interpretation, modification, termination and execution of this agreement are governed by the laws of the People's Republic of China (excluding the laws of Hong Kong, Macau, and Taiwan).
15.2 Any dispute arising out of or relating to this agreement or the Service shall first be resolved through good-faith negotiation. If negotiation fails, either party may bring an action before a competent court at the location of our operating entity.
15.3 If any provision of this agreement is held invalid or unenforceable, the validity of the remaining provisions shall not be affected. Our failure to exercise any right or remedy does not constitute a waiver thereof.
